Welcome to the Hydrium Studio Online Store (the “Site”). Hydrium Studio provides its services to you (the “User”) subject to the following conditions. Before you may use the Site, please read and accept all of the terms and conditions in, and linked to, this Terms of Service (“TOS”). It is strongly recommend that you read and apply these conditions. This TOS is effective upon use of the Site and/or purchasing of products from the Site or affiliated online resources (e.g., redirected to Hydrium Studio Market Site). Use of any functionality of the Site constitutes acceptance of this TOS. If you do not agree to be bound by this TOS and the Privacy Policy, you may not use the Site in any way.

Responsibility for Services: This site provides the User with access to Hydrium Studio’s inventory of products (the “Service”). Users are responsible for obtaining access to the Site, and that access may involve third-party fees (such as Internet service provider or airtime charges). In addition, the User must provide and are responsible for all equipment necessary to access the Site.

License and Site Access: Hydrium Studio grants the User a limited license to access and make use of the Site and the Service as a customer of the products for sale. This license does not include: any downloading or copying information/photographs for the benefit of another vendor or any other third party; caching, unauthorized hypertext links to the Site and the framing of any Content available through the Site uploading, posting, or transmitting any content that you do not have a right to make available (such as the intellectual property of another party); uploading, posting, or transmitting any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; any action that imposes or may impose (in Hydrium Studio’s sole discretion) an unreasonable or disproportionately large load on The Site’s infrastructure; or any use of data mining, robots, or similar data gathering and extraction tools. Users may not bypass any measures used by Hydrium Studio to prevent or restrict access to the Site. Any unauthorized use by the User shall terminate the permission and/or license granted to the User by Hydrium Studio, and may provide cause for Hydrium Studio to take legal action against the User.

Disclaimer of Warranty: ALL CONTENT (INCLUDING PHYSICAL PRODUCTS SHOWN) ON THIS SITE ARE PROPERTY OF HYDRIUM STUDIO, AND AS A SITE USER YOU AGREE TO NOT INFRINGE ON THAT OWNERSHIP BY DOWNLOADING CONTENT OR USING THE SITE IN ANY WAY OTHER THAN TO PURCHASE HYDRIUM STUDIO’S PRODUCTS OR PROMOTE ITS BRAND.

Limitation of Liability: YOU EXPRESSLY UNDERSTAND AND AGREE THAT HYDRIUM STUDIO AND ITS AFFILIATES, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU, THE USER, FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM USE OF THE SITE, ITS CONTENT OR ANY RELATED SERVICES.

Indemnity: Users agree to indemnify and hold Hydrium Studio (and its directors, agents, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys’ fees, or arising out of or related to the User’s breach of this TOS, or the User’s violation of any law or the rights of a third party.

Electronic Communication: When you use the Site and/or send emails to Hydrium Studio, you are communicating with Hydrium Studio electronically. You consent to receive communications electronically from Hydrium Studio and its Affiliates (as defined in the Privacy Policy). Hydrium Studio may communicate with you by email, phone, text, instant messaging and/or in person. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing.

Modification and Notification of Changes: Hydrium Studio reserves the right to make changes to the Site, related policies and agreements, this TOS and the Privacy Policy at any time. Any changes will be updated on the Site as needed.

Trademarks, content, and images: The trademarks, logos and service marks (“Marks”) displayed on the Site are the property of Hydrium Studio. Users are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or sites on the World Wide Web without the written permission of Hydrium Studio. All information and content available on the Site (“Content”) is property of Hydrium Studio. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.

General: If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that a court of law should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Hydrium Studio’s TOS and the relationship between the User and Hydrium Studio will be governed to no less extent than by the laws of the State of Michigan. The User and Hydrium Studio agree to submit to the personal jurisdiction of the federal and state courts located in the State of Michigan with respect to any legal proceedings that may arise in connection with this TOS. The failure of Hydrium Studio to act with respect to a breach by the User or other non-affiliated parties does not waive its right to act with respect to subsequent or similar breaches. Hydrium Studio does not guarantee it will take action against all breaches of this TOS. This TOS constitutes the entire agreement between the User and Hydrium Studio and governs the User’s access to the Site.

Payments: Any major Credit Card is the preferred method of payment at the Hydrium Studio Online Store (the Site). If using a Hydrium Studio gift card under applicable circumstances, please email hydriumstudio@gmail.com for the gift card promotional code. Payment is required at or before checkout, depending on how the payment is instituted. Please contact Hydrium Studio prior to purchase if you need additional time for payment or to set up a payment plan.

Shipping: Standard orders shall be shipped within 5 business days of purchase. Please be patient with a full-time schedule and allow Hydrium Studio 5 full business days to process your order. If you do not receive an order confirmation email within 5 business days of your purchase date please email hydriumstudio@gmail.com immediately. You will be notified if your order becomes delayed past the expected ship date and shipping upgrades will be added complimentary. All orders have a flat rate shipping cost of $7.95 (excluding the item charge). If you are local to Grand Rapids, MI and would like to pick up your order please make note at checkout.  Hydrium Studio will relay an email with dates and times that work to pick up. When you arrive, please email hydriumstudio@gmail.com and/or call with your name and that you ordered from the Hydrium Studio Online Store.

*Although most packages sent via USPS and FedEx have guaranteed delivery dates or time-frames very rarely packages are delayed. Because these shipping delays are out of my control, the seller is not responsible for liabilities due to postal delays.

**SHIPPING CHARGES MAY INCLUDE INSURANCE – HYDRIUM STUDIO RESERVES THE RIGHT TO IMPLEMENT INSURANCE FOR ALL SHIPMENTS. IF YOU RECEIVE A PACKAGE THAT APPEARS DAMAGED, PLEASE TAKE PHOTOS BEFORE OPENING TO AID THE REFUND/REPLACEMENT PROCESS.

All items for shipment are wrapped in recycled packaging. Gift wrapping is available, specify at checkout if you would like your products wrapped as a gift. Gift receipt included upon request.
